These Terms of Service ("Terms") govern your access to and use of the RankCaster AI platform, website, APIs and related services (the "Service"). The Service is operated by Digital Team of Terekh, Sderot Yeelim 72, Beer Sheva, Israel ("RankCaster AI", "we", "us" or "our"). By creating an account, starting a trial, purchasing a subscription or otherwise using the Service, you agree to these Terms and to our Privacy Policy.
1. Who May Use the Service
The Service is intended for businesses and professionals. You must be at least 18 years old and able to enter into a binding contract. If you use the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms on its behalf, and "you" refers to that organization.
2. Description of the Service
RankCaster AI is a software-as-a-service platform for measuring and improving how brands appear in AI-generated answers. Depending on your plan, the Service may include:
- Free and paid AI visibility audits of websites
- Brand projects, buyer personas and strategic prompt sets generated from information and files you provide
- Scheduled monitoring of answers from third-party AI assistants and answer engines, and metrics derived from them (for example, Answer Presence Rate and source citations)
- Content planning and AI-assisted content generation, including optional publishing to third-party platforms you connect
- An AI traffic measurement script that you may install on your own websites
- Technical site audits, knowledge graph and structured data tools, MCP / WebMCP tools and API access
- Public visibility certificates and shareable reports
The features, AI engines and usage limits available to you are those described for your plan on our pricing page and inside the Service at the time of purchase. We may add, change or remove features over time; if we remove a material paid feature during your billing period, we will offer a reasonable alternative or a pro-rata credit.
3. Accounts and Teams
You are responsible for:
- Keeping your login credentials and API keys confidential
- All activity under your account and organization, including by team members you invite
- Notifying us promptly at [email protected] of any unauthorized use
- Keeping your account and billing information accurate
4. Free Trial, Subscriptions and Payment
- Free trial. We may offer a free trial (currently 14 days) for eligible plans. Trial terms are shown at sign-up or checkout. If you provided a payment method, your subscription starts automatically at the end of the trial unless you cancel before it ends.
- Billing. Subscriptions are billed in advance on a recurring monthly or annual basis and renew automatically until cancelled. Add-ons and usage packs are billed as described at the time of purchase.
- Payment processing. Payments are processed by Stripe. We do not store your full card details. You authorize us, through Stripe, to charge your payment method for all fees due.
- Taxes. Prices exclude applicable taxes unless stated otherwise; you are responsible for any taxes associated with your purchase.
- Price changes. We may change prices. Changes apply from your next billing period and we will notify you in advance by email or in the Service. If you do not agree, you may cancel before the change takes effect.
- Failed payments. If a payment fails, we may limit or suspend paid features until the outstanding amount is paid.
5. Cancellation and Refunds
You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period, and you keep access to paid features until then. Fees already paid are non-refundable except as described in our Refund Policy or where required by applicable law.
6. Your Content and Data
You retain all rights to the content, files, brand information and data you submit to the Service ("Customer Content"). You grant us a limited licence to host, process and transmit Customer Content solely to provide, secure and support the Service, including by sending it to the third-party service providers described in our Privacy Policy. You confirm that you have the rights needed to submit Customer Content and that it does not infringe anyone's rights or violate any law.
7. AI-Generated Output
The Service uses large language models and other automated systems to generate prompts, analyses, recommendations and content ("Output"). Subject to these Terms and payment of applicable fees, you may use Output for your business purposes. You acknowledge that:
- Output may be inaccurate, incomplete or similar to output generated for others, and should be reviewed before you rely on or publish it
- You are solely responsible for content you publish, including through integrations you connect (for example, website or social media platforms)
- Monitoring results reflect answers from third-party AI systems at the time of measurement; those systems change frequently and are outside our control
8. No Guarantee of Results
We do not guarantee any specific ranking, visibility, citation, traffic, lead or revenue outcome. Metrics, forecasts and "expected outcomes" shown in the Service are estimates based on available data.
9. Tracking Script on Your Websites
If you install our AI traffic script or connect integrations that collect information about visitors to your websites or leads (for example, via MCP tools), you act as the controller of that data and we process it on your behalf to provide the Service. You are responsible for providing any notices and obtaining any consents required by law from your visitors, and for disclosing the use of the script in your own privacy policy.
10. Acceptable Use
You agree not to:
- Violate any applicable law or infringe the rights of others
- Submit unlawful content, malware or personal data you are not entitled to process
- Attempt to gain unauthorized access to the Service, other accounts or our systems
- Reverse engineer, scrape or systematically extract data from the Service except through our documented APIs
- Exceed or circumvent usage limits, rate limits or plan restrictions, or share accounts to avoid paying for additional seats
- Resell or sublicense the Service without our written consent (white-label features on eligible plans are permitted within their stated scope)
- Use the Service to send spam or to generate deceptive, defamatory or harmful content
11. API, MCP and Integrations
Access to our APIs and MCP endpoints is subject to these Terms, the documentation and the rate limits of your plan. Third-party services you connect (such as publishing platforms or CRMs) are governed by their own terms, and we are not responsible for them.
12. Intellectual Property
The Service, including its software, design, methodologies, scoring models and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. If you send us feedback, we may use it without obligation to you.
13. Confidentiality
We treat non-public Customer Content and business information as confidential and use it only to provide the Service. We do not disclose it to third parties except to service providers who need it to operate the Service, as described in our Privacy Policy, or where required by law. Content you choose to make public (for example, public certificates or shared report links) is not confidential.
14. Service Availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service depends on third-party AI systems, search and data providers whose availability we do not control. We may perform maintenance or temporarily suspend the Service when necessary.
15. Disclaimer of Warranties
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
16. Limitation of Liability
To the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities; and (b) our total liability arising out of or relating to the Service or these Terms will not exceed the amounts you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
17. Indemnification
You will indemnify us against third-party claims arising from your Customer Content, content you publish using the Service, your use of the tracking script or integrations, or your breach of these Terms.
18. Suspension and Termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, or if required by law. You may stop using the Service and delete your account at any time from your account settings. Deleting your account does not automatically refund fees already paid; please cancel any active subscription first. After termination, we will delete Customer Content as described in our Privacy Policy. Sections that by their nature should survive termination will survive.
19. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in the Service before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. The competent courts of Beer Sheva, Israel, have exclusive jurisdiction over any dispute arising out of or relating to these Terms, unless mandatory law provides otherwise.
